These Terms of Service ("Terms") govern your access to and use of the ClearPastAI mobile application ("App") provided by ClearPastAI ("we," "our," or "us"). Please read these Terms carefully before using the App.
By downloading, installing, or using ClearPastAI, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the App. We may update these Terms from time to time, and your continued use of the App after any changes constitutes acceptance of the updated Terms.
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the ClearPastAI App on your personal iOS device for your personal, non-commercial use, subject to these Terms. This license allows you to use all available features of the App, including AI photo enhancement, old photo restoration, black and white colorization, blurry photo correction, image upscaling, and color correction, in accordance with your subscription tier.
Enhanced photos produced by ClearPastAI are yours to keep, share, and use as you wish. You retain all rights to your original photos and the AI-enhanced versions created through the App.

The ClearPastAI App, including its design, code, AI models, algorithms, graphics, user interface, and all related intellectual property, is owned by ClearPastAI and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App beyond the limited use license described above.
The ClearPastAI name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ClearPastAI. You must not use these marks without our prior written permission.
Certain features of ClearPastAI require a paid subscription. Subscriptions are managed through your Apple ID and the App Store. By purchasing a subscription, you agree to the pricing and payment terms presented at the time of purchase.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
While our AI photo enhancement technology strives to deliver the best possible results for photo restoration, colorization, image upscaling, blur correction, and color correction, we do not guarantee specific outcomes for any individual image. Results may vary depending on the quality and condition of the original photo.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLEARPASTAI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other appropriate means. Your continued use of ClearPastAI after the effective date of any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ClearPastAI operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
